The information in this Agreement is to be used for the purpose of obtaining credit and is warranted to be true. Credit Applicant’s signature attests corporate financial responsibility, ability and willingness to pay invoices within our issued credit terms. The Credit Applicant shall pay any legal costs, including but not limited to fees and disbursements as well as any costs incurred in the attempted collection of overdue accounts. Interest rates of 2% per month, compounded monthly, shall be levied on all past due accounts (24% per annum). The Credit Applicant(s) consent(s) to HCI Lighting making any inquiries it deems necessary to reach a decision on this application, and consent(s) to the disclosure at any time of any credit information about the Credit Applicant to any credit reporting agency or to any one with whom I/we have had financial relations. In accordance with the terms and conditions of this Agreement as set out, HCI Lighting may, from time-to-time and at the sole discretion of its’ Credit Department, extend credit for the sale of goods and services to the Credit Applicant, who is a firm in good standing. Should HCI Lighting extend credit to the Credit Applicant, by affixing their signature to this document, the Credit Applicant hereby agrees as follows: 1. The Credit Applicant agrees to comply with HCI Lighting’s Terms & Conditions of Sales, available on www.hcilighting.com. 2. The Credit Applicant shall pay all outstanding moneys when they are due. 3. Shall the account become overdue, all in-house orders will be placed on hold until payment is received in full. 4. The legal location of all sales shall be Mississauga, Ontario Canada. 5. HCI Lighting reserves the right to cease credit at any time at its sole discretion. 6. The Credit Applicant agrees that, if any cheque or other form of payment is returned by the bank for any reason, including but not limited to Non-Sufficient Funds and Stop Payment, HCI Lighting shall initiate an exclusive Cash-On-Delivery (COD) policy. In this instance, only certified cheques, money orders, or electronic funds transfers will be accepted. 7. In the event of disputes between HCI Lighting and the Credit Applicant, it is agreed that resolution shall be reached using binding arbitration. 8. If Credit Applicant is a partnership, all debts are incurred jointly and severally. *
